OCS Rehabilitation Assistance Rules 2026: Group-D Jobs and Process

When an employee dies in harness, the Establishment section must immediately determine whether the family qualifies for compassionate appointment and process the claim under the correct framework. With the supersession of the 2020 rules, appointing authorities need to know who is eligible, which post can be offered, and how pending or previously rejected cases must now be treated.

The short answer

Under the Odisha Civil Services (Rehabilitation Assistance) Rules, 2026, compassionate appointment is granted exclusively against base-level Group-D posts. The 100-point evaluation system has been abolished, and all applications previously rejected solely under that system must be reconsidered. The primary entitlement rests with the spouse; other family members may only be nominated if the spouse is deceased, above 50 years of age and unwilling, or certified medically unfit.

What the rule actually says

GA & PG Department Notification No. 26212/Gen. dated 18.08.2026 provides under Rule 3(1) and Rule 8(2):

"Subject to provisions contained in these rules, one eligible family member of the deceased Government servant shall be considered for compassionate appointment only against a base-level Group-D post."

"All applications rejected solely on the grounds of ineligibility arising out of 100 point evaluation system, under the Odisha Civil Services (Rehabilitation Assistance) Rules, 2020, shall be reconsidered by the appointing authority in accordance with the provisions of these rules."

The 2026 rules entirely replace the 2020 rules. They clarify that compassionate appointment is not a matter of right and is restricted to Group-D vacancies without following regular recruitment exams, though general eligibility and educational criteria still apply.

How it works in practice

An application must be submitted in Form-B to the Appointing Authority of the deceased employee along with the Legal Heir Certificate, unfitness certificate (if applicable), and nomination in Form-A.

For Secretariat departments, the post is provided within the Department; if no vacancy exists, it is referred to the Heads of Departments under its administrative control.

Where people get this wrong

  1. Spouse already employed: If the surviving spouse is already employed under the Central Government, State Government, PSU, Statutory Body, or Autonomous Body, no family member is eligible for appointment under these rules.
  2. Seeking Group-C appointments: The 2026 rules strictly limit appointments to Group-D base posts. Appointing authorities cannot consider applicants for Group-C posts regardless of educational qualifications.
  3. Educational exemption scope: The relaxation of educational qualifications applies solely to the widow of the deceased employee if the appointing authority is satisfied she can perform the duties. It does not extend to other nominees or relatives.
  4. Failure to support family: The appointee must execute a formal undertaking to maintain the surviving family. Violating this undertaking constitutes gross misconduct and attracts major penalty proceedings under the OCS (CCA) Rules, 1962.

Once an appointment is accepted under these rules, the appointee cannot claim any other post under Rehabilitation Assistance, and any subsequent resignation does not transfer the claim to another family member. All establishment sections must dispose of eligible pending cases strictly in chronological order of the government servant's death.
